Privacy Policy

This online survey instrument (“Software”) is provided by Workforce Transformation LLC, a Florida limited liability company (“WFT”), located at 15 Point Pleasant Road, Hopatcong, New Jersey 07843.  By using the Software, you acknowledge and agree to the terms of this Privacy Policy.  This Privacy Policy describes WFT’s privacy practices in relation to your use of the Software and any information that is obtained by WFT from your use of the Software.  The Software is provided via SurveyMonkey.  SurveyMonkey may have its own privacy practices that differ from those of WFT, and those practices will be applicable to you during your use of the Software.  WFT encourages you to review their privacy policy as well. 

  1. INFORMATION WFT MAY COLLECT FROM YOU

WFT collects information from you when you provide responses to questions contained in the Software (“Collected Information”).  Some of the Collected Information, on its own or when combined with information publicly available about you, may allow a recipient of that Collected Information to identify you personally.  If you have any questions about what Collected Information WFT maintains about you, please contact us at JTopor@wftransform.com. 

  1. HOW WFT USES COLLECTED INFORMATION

WFT uses the Collected Information to perform analyses and extract data such as trends or habits concerning your workplace activities.  WFT may use Collected Information to enforce its Terms of Use or other policies or to protect WFT’s intellectual property and other rights or the rights of others impacted by your use of the Software.  WFT’s use of the Collected Information in this manner may allow for you to be identified personally.  WFT may also aggregate and anonymize your Collected Information with the collected information of all other users of the Software (“Aggregated Data”).  WFT would use this Aggregated Data as a statistical measure and not in a manner that would identify you personally. 

  1. HOW WFT SHARES COLLECTED INFORMATION

WFT will only share Collected Information (i) in accordance with this Privacy Policy, (ii) as required or permitted by applicable law, (iii) as necessary in connection with any investigation or complaint regarding your use of the Software, or (iv) to enforce the terms of this Privacy Policy or WFT’s Terms of Use related to the Software.  WFT does not sell Collected Information unless it is Aggregated Data.  WFT may sell the Aggregated Data to third parties in WFT’s sole discretion or otherwise make the Aggregated Data available to third parties in any other manner in WFT’s sole discretion. 

WFT may share Collected Information with WFT’s contracted customers (“Customers”) that provided you with access to the Software.  Those Customers hired WFT to conduct the surveys provided by the Software.  By using the Software when provided to you by a WFT Customer, you consent to WFT’s sharing of your Collected Information with that Customer.  WFT’s Customers may have their own privacy practices that differ from those of WFT.  WFT encourages you to review their privacy policies to understand how they will treat the Collected Information they receive from WFT. 

  1. USE OF THE SOFTWARE BY CHILDREN

The Software is not intended for use by children.  If WFT learns that it has obtained Collected Information of a child under 13, WFT will take steps to delete the Collected Information as soon as possible. 

  1. DATA RETENTION

WFT retains the Collected Information for as long as needed to accomplish the matters described in this Privacy Policy, comply with WFT’s legal obligations, resolve disputes, establish legal defenses, conduct audits, and enforce WFT’s agreements all in accordance with WFT’s record retention practices. 

  1. SECURITY

WFT maintains and uses appropriate administrative, technical, and physical security measures based on industry security standards and best practices and in accordance with all applicable law, to preserve the confidentiality, integrity, and availability of all Collected Information and Aggregated Data it maintains and shares.  Upon written request, WFT will provide you with copies of any third-party audits and assessments of its security measures.  While WFT follows industry security standards and best practices to protect information WFT maintains and shares, no method of storage or transmission is 100% secure. 

  1. CHANGES TO THIS PRIVACY POLICY

From time to time, WFT may change this Privacy Policy to accommodate new technologies, industry practices, regulatory requirements or for other purposes.  A notice will be posted in connection with the Software along with the updated Privacy Policy when WFT changes the Privacy Policy in a material way.  Your use of the Software following any change or amendment constitutes your consent to the change or amendment, as applicable.
